1. About our services
We provide website design, development, redesign, eCommerce, landing page, and UI/UX services. Information on this website is general and does not form a binding offer. Specific services are provided under a written proposal, quotation, or agreement.
2. Proposals and project agreements
A quotation or proposal is not binding until it is accepted in writing. Each proposal sets out the scope, deliverables, number of design revisions, timeline, and fees for the project. If a signed or accepted proposal conflicts with these terms, the proposal applies to that project.
3. Your responsibilities
To keep a project on track, you agree to:
- provide accurate information, content, and brand assets on time;
- make sure you have the right to use everything you supply (text, images, logos, and data);
- give feedback and approvals within the agreed timeframes; and
- keep any login details we share with you secure.
Delays in providing content or approvals may affect the timeline and cost.
4. Fees and payment
Fees and payment schedules are stated in your proposal or invoice. Third-party costs are separate unless the proposal says otherwise. These can include domain registration, hosting, premium themes, paid plugins, stock assets, payment gateway fees, and third-party subscriptions. Our Refund & Cancellation Policy explains what happens if a project is cancelled.
5. Intellectual property
You keep ownership of the materials you supply. Rights in the final website design and code we create for you are transferred or licensed as described in your proposal, normally once all fees are paid in full. Third-party components such as themes, plugins, fonts, and stock assets remain subject to their own licences. We will show your project in our portfolio only with your permission.
6. Third-party platforms and services
Projects may rely on third-party platforms and services such as WordPress, Shopify, hosting providers, payment gateways, and plugins. Their terms, prices, features, and availability are controlled by those providers, not by us.
7. No guarantee of results
We design websites with search-friendly structure, usability, and performance in mind. However, we do not guarantee search rankings, traffic, leads, conversions, or sales, which depend on many factors outside our control.
8. Acceptable use of this website
You agree not to misuse this website. This includes attempting to gain unauthorised access, disrupting its operation, introducing harmful code, submitting false or unlawful content, or copying our content or design without permission.
9. Our website content
The content, design, logo, and materials on this website belong to WebDesign.Agency or its licensors. You may view and share links to pages for personal or business reference, but may not reproduce or republish them without written permission.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, data, or business opportunity arising from the use of this website or our services. Our total liability for any claim relating to a service is limited to the fees you paid us for that service. Nothing in these terms excludes liability that cannot be excluded by law.
11. Suspension and termination
We may suspend or end our services if these terms or a project agreement are breached, if payments are overdue, or if we cannot continue the work for legitimate reasons. Cancellation and refunds are covered in our Refund & Cancellation Policy.
12. Changes to these terms
We may update these terms from time to time. The “Last updated” date shows the latest version. Projects already agreed continue under the terms that applied when they were accepted, unless both parties agree otherwise.
13. Governing law
These terms are governed by the laws of the jurisdiction in which WebDesign.Agency is established. Disputes will be handled by the competent courts of that jurisdiction, unless your project agreement states otherwise.
